Notice of the Passing of a Zoning By-Law
Take Notice that the Council of the Corporation of the Township of Georgian Bay passed By-law No. 2025-034 on April 8, 2025 (the “Proposed By-law”). Council passed the Proposed By-law pursuant to Section 34 of the Planning Act, R.S.O. 1990, c. P.13.
The purpose and effect of the proposed Zoning By-law Amendment:
The purpose of the zoning by-law amendment is to amend Township of Georgian Bay Zoning By-law 2014-75 by:
- Amending Sub-sections 1.1, 1.3, 1.4, 1.5 and 3.1 to state that the amendment applies to all lands, islands, waterbodies and navigable waterways within the jurisdiction of the Township of Georgian Bay.
- Amending Sub-sections 4.1.13.7 and 4.6 to prohibit floating accommodations in any zone.
- Amending Section 19 by:
- Adding ”Floating Accommodation” as a new definition in the Zoning By-law.
- Amending the definitions of “Boat, Live-aboard”, “Boathouse, In-water”, “Camp Site”, “Marina” and “Marine Vessel” to better define those uses as they relate to or are distinguished from “Floating Accommodation”.
The effect of the zoning by-law amendment is to provide clarity in the zoning by-law that floating accommodations are not a permitted use in the Township of Georgian Bay.
An Open House was held on September 25, 2024 and a Public Meeting was held on October 8, 2024. Prior to making a decision, Council took into account a total of 6 written submissions and 5 oral submissions.
Take Notice that the Proposed By-law may be appealed to the Ontario Land Tribunal by: the applicant; the Minister; and (if they made oral submissions at a public meeting or written submissions to Council) a specified person, a public body, and the registered owner of the Subject Lands. Any appeal should be made no later than May 5, 2025. Instructions on how to make an appeal can be found at: https://olt.gov.on.ca/file-an-appeal/
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
