Township of Georgian Bay confirms position regarding appeal to OLT Decision 23-000741
Georgian Bay, Ontario OBD Developments Inc, known as Oak Bay Developments, were successful in their appeal at the Ontario Land Tribunal (OLT-23-000741) with respect to rock crushing at their Summerside development, in Port Severn through a decision dated the 15th of April, 2024.
As a reminder, in 2022 Oak Bay Developments submitted a Zoning By-law amendment application (Z22-12) to temporarily permit rock crushing for a period of two-years. Rock excavated in the process of construction of Oak Bay has been stockpiled at the Summerside location.
Following the OLT decision, staff organized a Special Council meeting on the 22nd of April, 2024 whereby during Closed Session a detailed briefing on potential next steps was provided by Township’s legal counsel.
The outcome of the meeting was that Council has unanimously agreed to appeal this decision with all the tools at its disposal.
Council has directed staff to organize and hold a virtual Township meeting to discuss resident concerns related to rock crushing. The Township’s legal counsel will participate in part of the meeting to help answer questions, to the extent possible, 2 while not compromising the Township’s position in defending the matter. This online meeting will take place during the month of May 2024.

The meeting will commence with some opening remarks from Mayor Koetsier, followed by an open forum including 30 minutes with the Township’s legal counsel covering as many previously submitted questions as possible. A broader conversation with Council members and staff will take place after legal counsel has left the meeting.
